Microsoft Copilot is now embedded across Microsoft 365, Security, and other enterprise platforms, including drafting documents in Word, summarising emails in Outlook, and analysing data in Excel. The productivity gains are real. So are the compliance responsibilities.
• Microsoft Copilot operates within your existing Microsoft 365 permissions model; misconfigured access controls create direct compliance risk.
• A Data Protection Impact Assessment (DPIA) may be required for Copilot deployments involving personal data where the processing is likely to result in a high risk to individuals under GDPR Article 35.
• Sensitivity labels, audit logging, retention policies, and staff training are the operational foundation of compliant AI use, not optional extras.
• AI-generated outputs require human review before use in any legally or commercially significant context.
• The EU AI Act can reinforce governance requirements that may overlap with GDPR, including transparency, accountability, and human oversight.
Deploying Copilot without a governance framework creates measurable legal exposure. GDPR obligations, data residency requirements, and access control gaps do not resolve themselves because the technology is Microsoft-branded. Organisations that configure Copilot without deliberate oversight may face regulatory risk comparable to other large-scale personal data processing operations, depending on the use case and data involved.
This guide covers what Copilot actually does with your data, where the compliance risks are concentrated, and which governance steps reduce them.

Microsoft Copilot is a suite of AI-powered assistants embedded across Microsoft cloud services that uses generative AI and large language models to assist with tasks across Word, Excel, Teams, Outlook, and beyond. Microsoft 365 Copilot only surfaces organisational data to which individual users have at least view permissions, and that permission model places the governance burden on the organisation.
Three main configurations exist:
• Microsoft 365 Copilot: Drafts documents, generates meeting summaries, analyses data, and handles repetitive tasks across the Microsoft 365 suite.
• Security Copilot: Assists security teams in analysing threats, investigating incidents, and improving response times.
• Custom Copilots: Organisations can build tailored AI assistants using internal datasets and integrate them into specific workflows.
Because Copilot works within your Microsoft 365 tenant, it surfaces whatever information your permissions model exposes. Microsoft provides the platform; the organisation is responsible for configuring, monitoring, and governing its use.
Copilot can only be as compliant as the governance policies surrounding it. Without proper configuration, AI-assisted workflows pose three primary risk vectors: unintended data exposure, inaccurate outputs used in decision-making, and failure to meet GDPR accountability obligations.
• Unintended data exposure: Copilot can surface sensitive information from emails, SharePoint, or Teams if sensitivity labels and permissions are incorrectly configured.
• Inaccurate outputs: Generative AI produces plausible-sounding content that may be factually wrong, with direct consequences for legal documentation, reports, and external communications.
• Regulatory non-compliance: GDPR, HIPAA, and sector-specific frameworks all require accountability, transparency, and active protection of personal data. AI usage must align with those obligations, or it creates liability.
Organisations deploying Microsoft Copilot need to address four areas before going live: data residency and cross-border processing, access control and permissions, auditability, and human oversight. Each carries specific GDPR obligations that do not resolve automatically through Microsoft’s default settings.
Copilot relies on cloud infrastructure, which means data may be processed across multiple geographic locations. Organisations operating under GDPR need to confirm:
• Where Copilot processes and stores data
• Whether cross-border transfers comply with Articles 44–46 of GDPR
• How encryption, tenant boundaries, and retention policies interact with those transfer obligations
For EU customers, Microsoft 365 Copilot is an EU Data Boundary service, while customers outside the EU may have queries processed in the US, EU, or other regions, depending on service capacity and configuration.
Copilot inherits Microsoft 365’s access model, but administrators must actively manage it:
• Confirming AI only accesses content appropriate for the requesting user’s role
• Applying sensitivity labels and conditional access policies
• Reviewing access rights and permissions on a regular schedule
Failing to enforce strict access control can result in Copilot surfacing restricted or confidential information to users who would not ordinarily encounter it.
Generative AI introduces accountability challenges that standard IT logging does not address. Organisations should use Microsoft Purview and audit logs to:
• Track all AI interactions and outputs
• Maintain records for regulatory audits
• Demonstrate compliance with accountability obligations under GDPR Article 5(2)
AI is a support tool, not a decision-maker. Governance frameworks must define who is responsible for reviewing AI outputs, particularly for sensitive or legally consequential content:
• Validating AI-generated outputs before acting on them
• Reviewing AI-driven recommendations in risk-sensitive decisions
• Maintaining escalation workflows for high-stakes processes
Five governance measures address the primary compliance risks of Copilot deployment: a Data Protection Impact Assessment, data classification with sensitivity labels, retention and legal hold policies, active monitoring through Purview, and staff training on AI governance.
1. Conduct a Data Protection Impact Assessment (DPIA) where required. Under GDPR Article 35, a DPIA is required where the planned processing is likely to result in a high risk to individuals. It documents the risks and controls, and creates the accountability record regulators expect.
2. Apply Data Classification and Sensitivity Labels. Sensitivity labels help Copilot distinguish between public, internal, and confidential data, reducing the chance of accidental disclosures
3. Implement Retention and Legal Hold Policies. AI-generated outputs should be subject to the same retention policies that apply to emails and documents.
4. Monitor and Audit AI Usage. Review AI logs and reports in Microsoft Purview regularly. Flag unusual activity, misclassifications, and potential data exposure events before they become incidents.
5. Train Staff on AI Governance. Employees need to understand how Copilot works, its limitations, and their responsibilities under data protection law.
Four risk categories require ongoing attention after deployment: data leakage from misconfigured permissions, inaccurate AI outputs used in formal decision-making, regulatory non-compliance due to inadequate oversight, and vendor risk from third-party Copilot integrations.
• Data leakage: Improper permissions or unlabelled sensitive content can expose confidential data. Address this by enforcing strict access control and sensitivity labelling from the outset.
• Inaccurate AI outputs: Copilot may hallucinate or misinterpret information. All outputs used in formal decisions or legal documents require human review before use.
• Non-compliance with privacy laws: Without active oversight, AI usage can conflict with GDPR, HIPAA, and sector-specific obligations. DPIAs, where required, audit logs, and maintained audit trails can help address this risk.
• Vendor risk: Third-party integrations with Copilot introduce additional risk. Review vendor contracts and confirm processors meet applicable security obligations before integration.
The EU AI Act and similar regulatory developments can reinforce obligations that may apply to some Copilot deployments alongside GDPR. Transparency, accountability, and human oversight may be legal requirements depending on the use case and regulatory scope.
As AI regulations evolve globally, businesses using Copilot must address:
• Transparency obligations: explaining AI-assisted decisions to regulators or affected individuals
• Accountability requirements: maintaining documentation demonstrating appropriate governance
• Risk management expectations: integrating AI into organisational risk frameworks covering security, privacy, and operational risk
Where the EU AI Act applies to a high-risk AI system, its human oversight requirements are broadly consistent with governance measures many organisations already consider for Copilot.
Copilot can process sensitive data that resides in systems the requesting user is authorised to access, but this does not mean it is safe to do so without governance controls in place. Organisations must apply strict sensitivity labels, enforce conditional access policies, and restrict AI use for highly confidential datasets to reduce exposure risk.
Whether Copilot should process sensitive data in a given context is a governance question, not a technical one. The lawful basis for processing, the purposes for which data is being used, and the controls surrounding output handling all need to be defined before deployment.
Copilot does not automatically handle data subject requests. Organisations must confirm that AI-generated summaries, drafts, and outputs can be audited and accounted for in response to DSARs, erasure requests, and objections, and that human oversight is maintained throughout the process.
Personal data that Copilot accesses and processes may remain subject to GDPR data subject rights, depending on the context and any applicable exemptions or limitations.
Not without human review. Copilot outputs must be verified before inclusion in contracts, legal filings, or official communications. Generative AI produces plausible-sounding content that may be inaccurate or incomplete, and human validation is a legal as well as a practical requirement before any formal use.
Governance frameworks should specify who is responsible for reviewing and approving AI-generated content before it is used formally. Relying on unreviewed AI outputs in legal or regulatory contexts creates accountability exposure.
